Terms of service

1. Agreement

These terms govern use of this website and the services of WeSpark. By engaging us you agree to them together with your written proposal, which sets scope, deliverables, team and price.

2. Services

We provide Amazon advertising management, listing creation and optimisation, and creative services as described in the proposal. Work starts once access, assets and the first payment are received.

3. Client responsibilities

You confirm you own or are authorised to manage the Amazon accounts, brands and content you give us access to; you provide accurate information and timely approvals; and you remain responsible for product compliance, pricing and inventory.

4. Fees and payment

Fees are stated in the proposal and invoiced monthly in advance unless agreed otherwise. Payments are processed by Stripe. Late payments may pause work. Amazon advertising spend is paid by you directly to Amazon and is separate from our fees.

5. Term and cancellation

Monthly services continue until cancelled with 30 days' written notice by either party. Project work ends on delivery. See the refund & cancellation policy.

6. No guarantees

Amazon results depend on factors outside our control. We do not guarantee sales, rank, ACoS or any outcome; forecasts and benchmarks are estimates.

7. Intellectual property

Deliverables created for you (copy, images, A+ content, videos) become yours on full payment. Our methods, templates and tools remain ours. You grant us a licence to use your brand assets to perform the services and, only with your written permission, to reference the work as a case study.

8. Confidentiality and data

Each party keeps the other's non-public information confidential. We handle account data under our privacy policy and data security policy.

9. Liability

To the extent permitted by law, our total liability for any claim is limited to the fees paid to us in the three months before the claim. We are not liable for indirect or consequential loss, or for actions taken by Amazon on your account.

10. Independence from Amazon

WeSpark is an independent company and is not affiliated with, endorsed by or sponsored by Amazon.com, Inc. or its affiliates.

11. Governing law

These terms are governed by the laws of the State of Texas, USA. Disputes will be resolved in the courts of Harris County, Texas, unless the law of your country requires otherwise.
